Security Measures for Partner Visas Affected by Family Violence

If you have experienced family violence and your relationship has ended, you may still be granted a permanent residency in Australia. In this blog post, we will outline the process of applying for a permanent residency in Australia if you have experienced family violence. You will need to provide substantial form of material evidence to show that family violence occurred during the course of your relationship. However, with the help of an experienced immigration lawyer, you can make sure that your application is successful.

If you are a partner visa immigrant in Australia, you may have been affected by these recent changes. These changes were put into place in response to family violence, and they affect how your visa is processed and how long it takes to get approved. Here's what you need to know about these changes.

I reported my sponsor for family violence - Why has my Partner visa application disappeared?  

Once a partner relationship breakdown due to family violence is reported to the Department, as a security measure, any associated Partner visa applications will be removed from your ImmiAccount. This is to prevent the sponsor (and your former partner) from accessing the application and altering it without authorisation.  

You will be able to continue with your partner visa application, once you take the correct steps to retrieve your application.  

How do I get back my application form?  

Once the application is removed, you will need to following the below steps to obtain access to it again:  

1. Create a new ImmiAccount by going here. It is important when creating this account to use a username and security questions that is not known to the sponsor and link the account to an email address that is not able to be accessed by the sponsor.  

 2. Once your new ImmiAccount has been created, you will need to request access to your Partner visa application through the online ImmiAccount Technical Support Form. You will need to provide the following details in the form:  

 

  • A copy of your passport bio-page  

  • Your ImmiAccount username or email address.  

  • Your application TRN – this can be found on any previous correspondence you have received from the Department and at the bottom of your submitted application form. 

Please note that if you create or use a new email address and wish to use this email address to correspond with the Department moving forward, you will need to authorise this new email address by submitting a Form 1193.
