Temporary Skill Shortage Visa (SC482) (‘TSS’) – Short Term Stream to Permanent Residency

The federal government has announced a new legislative instrument that allows  TSS (subclass 482) visa holders in the Short-term Stream to apply for permanent residency under the Temporary Residents Transition stream of both Employer Nomination Scheme (SC186) visa and Regional Sponsored Migration Scheme (SC187) visa

This Instrument came into effect immediately on 18 March 2022 as the previous ‘grandfathering’ provision for the 457 visa holders ceased on the same date. 

 

What’s the Catch? 

Not everyone can take advantage, and this new instrument benefits largely two groups of people: 

  1. For those who held or have applied for 457 visa on 17 April 2017, which was subsequently granted; 

  2. For those who were in Australia (regardless of visa status) for at least 12 months between 1 Feb 2020 and 14 Dec 2021. 

 

For the first cohort, the Department is essentially extending the ‘grandfathering’ provision which have ended on 18 March 2022, to now until an unspecified date. 

The biggest news is for the second cohort – people who were in Australia for 12 months during COVID19 lockdown until Australia opened its borders. 

From 1 July 2022, this instrument allows this cohort of people to apply for the ENS (TRT) Visa, if they can satisfy the following: 

  • You were in Australia for 12 months between 1 February 2020 and 14 December 2021 (‘Specified period) 

  • Immediately before the application, you were employed by a person/sponsor in the nominated position as a 482 holder for 3 out of the 4 years.  

  • At the time of application, you are employed by a person/sponsor actively and lawfully operating a business in Australia.   

  • You have worked full time for same sponsor in the occupation  

  • Meet other criteria for SC186 or SC187
