Can I Apply for Another Visa While Holding My Current Visa with Conditions?

Many visa holders in Australia wonder whether they can apply for a different visa while still holding an existing visa that has specific conditions attached. Australian visas often come with conditions that restrict certain activities, such as:

  • Restrictions on work hours or employment type

  • Study limitations

  • Travel conditions

  • No further stay

Before applying for another visa, understanding these conditions can determine whether they impact your ability to lodge a new application.

Can You Apply for Another Visa?

Generally, yes. Most visa holders can apply for a different visa while their current visa is still active, including those with conditions. However, some considerations include:

  1. If your current visa is cancelled or if you have breached any visa conditions, your current visa can lead to refusal or a ban from reapplying. Speak with an Accredited Specialist in Immigration Law for tailored advice for your next visa.

  2. If you are inside Australia, you may be eligible to lodge a new application to apply for a different visa, often using a bridging visa to maintain lawful status. Unless you are section 48 bar, you may need to strategise your next visa options with an Accredited Specialist in Immigration Law.

  3. If you are outside Australia, ensure that your current visa's condition allows you to re-enter Australia before applying for a visa, as offshore visa applications doesn’t grant you with a bridging visa.

  4. Conditions like "No Work", "No Further Stay (Condition 8503)" or "Work Restrictions" do not necessarily prevent you from applying for a new visa—consult with an immigration lawyer if you require assistance.
