If My Partner is on a SC 482 And I’m on a SC 500 Visa—Can We Lodge a Partner Visa?

If your partner is on a Skills in Demand (SID) (Subclass 482) visa, and you are currently holding a Student Visa (Subclass 500), you may wonder if you have the option to apply for a Partner Visa (Subclass 820/801 or Subclass 309/100).  

 

Understand the Type of Visas 

  • Skills in Demand (SID) (Subclass 482) visa allows skilled workers to live and work in Australia with an approved employer for a maximum of 4 years. This is a temporary visa. 

  • Student visa (Subclass 500) allows international students to study full-time at an accredited institution in Australia while offering limited work rights. This is a temporary visa. 

 

What are the Partner Visa Eligibility Criteria?

There are eligibility criteria for both the sponsor and the visa applicant to be eligible to apply for the Partner Visa. The sponsoring partner must be either:

What are the Alternative Options? 

  • You can wait for your partner to transition from Subclass 482 to permanent residency (PR). Once granted a PR, they would be eligible to sponsor you for a Partner Visa. 

  • Consider other visa pathways that may allow you to stay in Australia, such as applying for a Temporary Graduate Visa (Subclass 485) if you meet the qualifications after your studies.
