New Hope for SC888 Visa Refusal Applicants: Ministerial Intervention Under New Guidelines
Received a refusal for your Business Innovation and Investment (Permanent) (Subclass 888) visa, can be disappointing. However, with recent changes to the new Ministerial Intervention (MI) process, there may be hope, as it offers a renewed chance for applicants for their cases to be reconsidered.
What is the New Ministerial Intervention (MI) Process?
The Minister has the power to intervene in individual visa cases if it is deemed to be in the public interest. However, the process in seeking this MI has been significantly altered starting in September 2025.
How Does This MI Process Affect Applicants with SC888 Visa Refusals?
Under the new Ministerial Intervention process, cases will be limited to only a selection scenario before being referred to the Minister for consideration. For visa applicants who previously received a refusal for their SC888 visa and previously held a SC188 visa, you may be eligible to request for a MI for visa to be reconsidered.
