Which Seniority of Lawyer Do You Decide to Engage With?

What is Included in the Scope of Work for Visa Applications? 

Engaging an immigration lawyer for your visa application is a process.  

  • Every journey starts with an initial consultation, also known as the Migration Planning Session (MPS) at AHC Lawyers, with an immigration lawyer for a suitable visa strategy based on your specific circumstances. At AHC Lawyers, we offer 2 types of MPS (an hour) with:  

    • A solicitor on duty for AUD 286 (GST inclusive) for straightforward cases.

    • An Accredited Specialist in Immigration Law for AUD 660 (GST inclusive) for complex cases.

  • The lawyers can assist with one specific stage as a partial service, such as an Expression of Interest (EOI), or a response to a Departmental query like a Natural Justice (S57) letter

  • The lawyers can also assist in handling the entire process from initial assessment to a visa application lodgement for full application management. This is typically the ideal arrangement, as the lawyers can have full oversight of each stage of the visa process. 

  • Once the visa application is lodged with the Department of Home Affairs (DoHA), the waiting game begins. Why Visa Processing Times Vary So Much? 

  • When a visa decision is made, your responsible lawyer will notify you of a grant or refusal.  

    • If refused or cancelled, you may continue to work with your lawyer to appeal the decision, often requiring a new Cost Agreement for the new scope of work.

What is the Common Fee Structure? 

Immigration lawyers primarily use these billing methods: 

  • Fixed fees 

    • Commonly used for clear, well-defined visa applications where the scope of work is known from the start. This provides cost certainty, as you know the total legal fee upfront for the agreed scope of work. 

  • Hourly rates 

    • Often used for complex, unpredictable cases like appeals, ART hearing attendance, character matters, Ministerial Intervention requests, where the exact amount of work cannot be precisely estimated beforehand. 

    • Hourly rates can range from $200 to $660+ per hour, depending on the lawyer’s seniority. 

 

A General Overview of Legal Costs 

Note: These estimates cover only professional legal fees and do not include government visa application charges (VACs) or other third-party disbursements. 

  • Initial MPS Consultation: from $286 - $660 (for an hour). 

  • Temporary Visas: from $2,500 - $5,000. 

  • Standard GSM Visa: from $2,000 - $12,000. 

  • Partner Visas: from $4,500 to $15,000 (higher for complex relationship histories, sponsorship limitations, or Schedule 3). 

  • Employer-Sponsored Visas (involves 3 stages of Sponsorship, Nomination, and Visa): from $3,000 - $8,000 per stage. 

  • Complex Cases: These can start at $5,000 and easily go into the $10,000 to $ 30,000+ range, especially if they involve multiple stages of review or require extensive legal arguments. 

 

What is NOT Included in the Lawyer’s Professional Fee?
