How You Can be Eligible for Direct PR for Partner Visa?

You may have heard that some couples have received a double grant for both their temporary and permanent Partner Visa grant at the same time, as a result of a shorter processing time as compared to the usual Partner visa processing times. One may be wondering how it works and why it only occurs to some couples. With the attraction of a shorter processing time, you, yourself, may question if your relationship will be eligible for a direct PR Partner Visa pathway.

Partner Visa: Two-Stage Process

Partner Visa applicants typically go through a two-stage process:

  • Subclass 820 or Subclass 309 are the Partner Visa’s Temporary or Provisional Stage. This visa allows the applicant to live, work, and study in Australia while awaiting permanent residency (PR).

  • Subclass 801 or Subclass 100 are the Partner Visa’s Permanent Stage. This visa grants full permanent residency (PR) status, freedom to travel, and eligibility for citizenship later. This stage is usually assessed 2 years after the lodgement of your initial application date.

How can couples be Eligible for a Direct PR (Double Grant) for a Partner Visa?

In some cases, couples may skip the two-stage process and receive both the temporary and permanent Partner visas at the same time. This is known as a double grant or direct PR pathway.

What are the Eligibility requirements for a Partner Visa Double Grant?

You may be eligible if:

  • You have been in a long-term relationship (at least 3 years) at the time of application; or

  • You have been in a relationship with a dependent child together.

In these cases, if the Department is satisfied with your evidence, you may be granted both the temporary (820/309) and permanent (801/100) Partner visas simultaneously. If you wish to access the opportunity for the Department to assess direct PR for your Partner visa, our immigration lawyers can assist in submitting a legal submission to explain more in-depth.
