Can VACCU Refuse My Permanent Residency (PR) Application?

If you have applied for permanent residency (PR) in Australia and received a notification that your application has been referred to VACCU, it is understandable that you may be confused and anxious. What is VACCU? 

VACCU stands for the Visa Applicant Character Consideration Unit. It is a specialised branch within the Department of Home Affairs (DoHA). If a standard case officer identifies an issue regarding your character, they must pause your application and send it to VACCU for a comprehensive legal assessment.

Why Was My PR Application Sent to VACCU? 

Under Section 501 of the Migration Act 1958, every person applying for a visa to enter or remain in Australia must pass the character test. Your application will be referred to VACCU if there is any indication that you might fail this test. Common VACCU referral reasons include:

How Does VACCU Decide to Refuse or Grant PR? 

If VACCU assesses your file and believes you fail the character test, they will send you a Notice of Intention to Consider Refusal (NOICR). When deciding whether to refuse your PR application, VACCU delegates are bound by strict Ministerial Direction 110. They must weigh several primary considerations against your right to remain in Australia, including: 

  • Protection of the Australian community 

  • Family violence 

  • Best interests of minor children 

  • Expectations of the Australian community 

They will also consider secondary factors, such as how long you have lived in Australia, your ties to the community, and the impact a refusal would have on your Australian family members.

What to Do If You Receive a Notice from VACCU 

If you receive correspondence from VACCU, your PR application's survival depends on how you respond

  • VACCU notices come with non-negotiable deadlines. If you do not respond in time, a decision will be made without your input, which results in a visa refusal

  • Be honest and complete in your response. Any attempt to hide, minimise, or misrepresent relevant information may be viewed as a lack of remorse and can seriously damage your case. 

  • A simple apology letter is not enough. You must provide a strong, structured legal submission with evidentiary building, supported by case law and policies. 

  • Character cases are highly complex. Standard migration agents often do not have the litigation experience required to handle Section 501 character submissions. You need an Accredited Specialist in Immigration Law who specialises in complex character matters.

A referral to VACCU puts your Australian future at serious risk, but it is a fight you can win with the right strategy and evidence. Keep in mind, if you attempt to hide a past conviction or downplay an incident, VACCU will likely find out.
