Which Australian Visas Subclasses Are Affected by PIC 4013 and PIC 4014?
There are various Public Interest Criteria (PIC) to ensure visa applicants meet specific standards before being granted a visa. Among these criteria are PIC 4013 and PIC 4014, which can impose restrictions on applicants with past visa issues. These PICs can impact the eligibility of visa applicants applying for various visa subclasses.
Which Visas Subclasses May Be Affected by PIC4013 or PIC 4014?
PIC4013 primarily applies to applicants who have previously had a visa refused or cancelled due to non-compliance with visa conditions or character concerns. It restricts these affected applicants from reapplying for certain visas unless they can demonstrate compelling reasons and seek a waiver.
PIC4014 applies to individuals who have previously left or been removed from Australia unlawfully, do not hold a substantive visa, or have been deported. It restricts their ability to re-enter Australia within a specific period, typically 3 years, unless they can demonstrate exceptional circumstances through a waiver.
Visa subclasses that may be affected are:
Temporary Work (International Relations) (Subclass 403) Visa
Border (Subclass 773) Visa
Suppose you are applying for any of the abovementioned visa subclasses and believe you may be affected by one of the PICs. In that case, we highly recommend speaking with one of our Accredited Specialists in Immigration Law, Jason Ling or Angela De Silva.
